Terms of Service

This document is a starting template and should be reviewed by qualified legal counsel before launch.

1. Acceptance of terms

By creating an account or using LeadsListPro (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

LeadsListPro provides tools to search, segment, preview and export contact records. Data is provided "as is" for lawful business use. We do not guarantee the accuracy, completeness or deliverability of any particular record.

3. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may enable two-factor authentication to help protect your account.

4. Acceptable use & data compliance

You agree to use exported data only for lawful purposes and in compliance with all applicable laws, including the TCPA, CAN-SPAM Act, telemarketing/Do-Not-Call rules, GDPR and CCPA. You will not:

• Send unsolicited communications in violation of applicable law;
• Resell, sublicense or redistribute the raw data except as expressly permitted;
• Attempt to re-identify masked data, scrape the Service, or bypass credit limits;
• Use the data for discriminatory, fraudulent or unlawful purposes.

You are solely responsible for how you use exported records, including honoring opt-out and suppression obligations.

5. Credits & billing

Credits are sold as one-time credit packs — you pay once and the credits are added to your balance. Credits do not expire. One credit is consumed per exported record. Credits are validated before consumption; if an export returns no results or fails, no credits are charged and any provisional deduction is reversed. There is no subscription and no recurring charge. Payments are processed through our payment processor (PayPal).

6. Purchases & refunds

You may buy additional credit packs at any time from your account, and the credits are added to your balance instantly. Because there is no subscription, there is nothing to cancel. Except where required by law, fees already paid are non-refundable.

7. Data license & restrictions

Subject to these Terms and payment, we grant you a limited, non-exclusive, non-transferable license to use records you export for your own internal business purposes. All rights not expressly granted are reserved.

8. Intellectual property

The Service, software, and branding are owned by LeadsListPro and protected by law. You may not copy, modify or create derivative works of the Service.

9. Disclaimers

THE SERVICE AND DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADSLISTPRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR AMOUNTS EXCEEDING THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold LeadsListPro harmless from claims arising out of your use of the Service or exported data in violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access for violation of these Terms. You may close your account at any time.

13. Governing law & changes

These Terms are governed by the laws of the jurisdiction in which LeadsListPro is established, without regard to conflict-of-law rules. We may update these Terms; material changes will be posted here with a new date.
